Employment-based Permanent Residency

A National Interest Waiver (NIW) is a form of relief from the usual labor certification process for certain employment-based immigration cases. In general, most employment-based immigration petitions require an employer to first obtain a labor certification from the Department of Labor (DOL) stating that there are no qualified U.S. workers for the position being offered and that the foreign worker’s employment will not adversely affect the wages and working conditions of similarly employed U.S. workers.

However, in certain cases, it may be in the national interest for the foreign worker to be able to bypass the labor certification process. In such cases, the foreign worker can apply for a National Interest Waiver (NIW) of the labor certification requirement.

To qualify for an NIW, the foreign worker must demonstrate that their work will be in the national interest and that the national interest would be adversely affected if the labor certification process were to be followed. This can be demonstrated by showing that the foreign worker has exceptional abilities in their field, that their work will have a significant impact on the U.S. economy, or that their work will be in the national interest in some other way.

National Interest Waiver is a difficult process, the foreign worker should have a high level of achievements and demonstrate that their work is of national importance.

Family-based Permanent Residency

Family-based Sponsorship

Family-based sponsorship is a type of immigration process in the United States that allows U.S. citizens and legal permanent residents (LPRs) to sponsor certain family members for immigration to the United States. This process is also known as “family-based immigration” or “family sponsorship.”

There are two main categories of family-based sponsorship: immediate relatives and family preference.

Immediate relatives are the spouse, children (unmarried and under 21 years of age), and parents of a U.S. citizen. There is no annual limit on the number of visas that can be issued to immediate relatives, so they can generally get their visa soon after they apply.

Family preference, on the other hand, includes other relatives such as unmarried adult children of U.S. citizens, married children of U.S. citizens, and siblings of U.S. citizens. There are annual limits on the number of visas that can be issued for family preference categories, and the wait time for a visa can be much longer.

The process for family-based sponsorship begins with the U.S. citizen or LPR sponsor filing a petition on behalf of the family member. Once the petition is approved, the family member will go through a process that includes interviews, background checks, and medical exams. After the process is completed, the family member will be issued a visa and will be able to enter the United States.
